Terms, conditions and disclaimers

These terms, conditions and disclaimers contain legal obligations (herein referred to as the Agreement) governing the usage of the websites Morelmag.ca and ErraticPress.ca (the Websites), and the end user (the User). The Websites are online information services provided by Mary Baxter operating as Erratic Press (Erratic Press). Please read this Agreement carefully before accessing or using the Websites and their related services or products. By accessing or using the Websites, their related services or products, the User agrees and contracts with Erratic Press to use the Websites according to the terms, conditions and disclaimers outlined in this Agreement. If the User does not wish to be bound by this Agreement, the User may not access or use the Websites, their related services or products.   

Erratic Press reserves the right to update this Agreement at any time without notice.

The User has the obligation to review changes to the Agreement.

The terms of use in this Agreement were last updated on April 13, 2015.

    1.    Proper Use. The Users agree that they are responsible for their use of the Websites and for any posts that they make and for any consequences which result therefrom. The Users agree that they will use the Websites in compliance with all applicable local, municipal, state, provincial, federal, national and international laws, rules and regulations.

    2.    Grant of Licence. This Agreement provides the User with personal, revocable, non-exclusive, non-transferable licence to use the Websites conditioned on the User’s continued compliance with this Agreement. The User may print and download information on the Websites solely for personal and non-commercial use. Except as otherwise expressly permitted herein, the User may not copy, modify, reproduce, distribute, license, sell, create derivative works from or otherwise use any information or material obtained through the Websites. Users also agree that they will not use the Websites for any unlawful purposes.

    3.    Intellectual Property Rights. The User acknowledges that the creators of the Websites own all rights, title and interest in and to these Websites including, but not limited to, all intellectual property rights. Unless otherwise indicated, all material on the Websites is protected by law to the fullest extent possible. The User acknowledges that articles and comments on the Websites represent individual viewpoints of other users, and are not necessarily the views of Erratic Press as a whole.

    4.    Privacy Use. Certain features on the Websites require a user name and password. To operate these features, Erratic Press collects certain personal and non-personal information from the User. The User’s registration will be handled in accordance with our Privacy Policy, which the User should review prior to registering with Erratic Press.

    5.    Assumption of Risk. Use of the Websites is solely at the User’s own risk. Please be aware that the confidentiality of any communication or material transmitted to and from the Websites over the Internet cannot be guaranteed.

    6.    Severability of Terms. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the User and Erratic Press nevertheless agree that the court shall endeavor to give effect to the parties´ intentions as reflected in this provision, and that the other provisions of the Agreement shall remain in full force and effect. This Agreement shall be governed and interpreted in accordance with the laws of the Province of Ontario.

    7.    Dealings with Third Parties. The User acknowledges and agrees that the User’s correspondence or business dealings with any third parties, including any merchants or advertisers, found on or through the Websites, their products or services are solely between the User and such third parties. Erratic Press assumes no responsibility for any charges the User incurs when interacting with such third parties. Further, the responsibility for ensuring compliance with all applicable laws in connection with any such transactions will be the User’s alone. The User agrees Erratic Press will not be responsible or liable in any way for any loss or damage of any kind incurred as a result of, or in connection with, any such dealings or transactions.

    8.    Indemnification. The User agrees to defend, indemnify and hold harmless each member of Erratic Press and each of their respective employees and agents, including all third parties mentioned in or on the Websites, from and against any and all claims, actions or demands, including without limitation reasonable legal and accounting fees, resulting from or related to (a) the User’s breach of any of these Terms and Conditions, (b) the User’s access to or use of the Websites, the services they offer or their content, or (c) the User’s use or reliance on, or publication, communication or distribution of, anything on or from the Websites, their services or products. Users will use their best efforts to cooperate with Erratic Press in the defence of any claim. Erratic Press reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you.

    9.      Miscellaneous. This Agreement shall all be governed and construed in accordance with the laws of Ontario applicable to agreements made and to be performed in Ontario. You agree that any legal action or proceeding between Erratic Press and you for any purpose concerning this Agreement or the Parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Ontario. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Erratic Press's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the Parties nor trade practice shall act to modify any provision of this Agreement.

    10.    Disclaimers. Although Erratic Press strives to provide you with reliable and accurate information, the information on this site may include inaccuracies or errors. Erratic Press does not warrant, either expressly or by implication, the accuracy of any information or materials provided on the Websites. The information on the Websites is provided as is and without warranty of any kind, including all warranties of merchantability and fitness for particular purpose. The User assumes the risk of making use of and/or relying on the information available through the Websites. Erratic Press shall not be liable, nor shall it have responsibilty of any kind, to the User for any loss or damage that incurs due to accessing the Websites or the materials on the Websites.
